Please read all 12 sections about the policies and guidelines.

The 12 sections below, The Photography Agreement (“Agreement”) is entered into by and between TJ Supreme Media (“Photographer”) and the individual booking the photography session (“Client”). This Agreement becomes legally binding upon booking, submission of payment, or signature.

Policies & Guidelines

1. Inclement Weather

(01)

In the event of rain, storms, or other unsafe weather conditions, the Photographer reserves the sole right to reschedule the session at no additional cost. Weather-related delays or rescheduling shall not constitute grounds for cancellation, refund, or compensation.

2. Rescheduling, Lateness & Cancellations

(02)

The Client is permitted one (1) complimentary reschedule with a minimum of forty-eight (48) hours’ notice. Any additional reschedule requests are subject to availability and may incur additional fees. A fifteen (15) minute grace period is allowed for late arrivals and is included within the scheduled session time. After the grace period, a $30 late fee will apply. If the Client fails to arrive or communicate within thirty (30) minutes of the scheduled start time, the session shall be considered a cancellation and subject to a $50 rescheduling fee. No-shows are not guaranteed rebooking. If the Photographer is delayed, the Client will receive the full contracted session time. Photographer delays do not warrant a refund or discount.

3. Proofs & Image Delivery

(03)

Proofs will be delivered within forty-eight (48) hours following the session. Once final image selections are made, the completed edited gallery will be delivered within ten (10) business days, excluding weekends and holidays. Turnaround times may vary during peak seasons.

4. Early Image Requests

(04)

Any request for expedited image delivery must be made in advance. Up to two (2) images may be delivered early for announcements or invitations, and these images will count toward the final total. Expedited delivery is available by request only and is not guaranteed without written approval from the Photographer.

5. Refund Policy

(05)

All payments are non-refundable, and all sales are final. If the Client expresses dissatisfaction within forty-eight (48) hours of gallery delivery, the Photographer may, at their sole discretion, issue a partial refund of up to thirty percent (30%) of the session fee. Artistic style, posing, lighting, composition, and editing choices are subjective and do not constitute grounds for a full refund.

6. Model Release (Adult Clients)

(06)

The Client hereby grants TJ Supreme Media the irrevocable, perpetual, and unrestricted right to use, publish, reproduce, display, and distribute images from the session for portfolio use, website display, social media, advertising, marketing, editorial, and promotional purposes, without compensation. The Client waives any right to inspect or approve the final images or their use and releases the Photographer from all claims, demands, and liabilities related to image usage.

7. Minor Client & Parent/Guardian Consent

(07)

If the Client or photographed subject is under the age of eighteen (18), a parent or legal guardian must agree to and sign this Agreement on the minor’s behalf. The undersigned parent or legal guardian represents and warrants that they are the legal guardian of the minor and have full authority to grant consent. The parent or legal guardian hereby grants TJ Supreme Media the irrevocable, perpetual, and unrestricted right to photograph the minor and to use, publish, reproduce, display, and distribute the resulting images for portfolio use, website display, social media, advertising, marketing, editorial, and promotional purposes, without compensation. The parent or legal guardian releases and holds harmless TJ Supreme Media from any and all claims, demands, or liabilities arising from the use of the minor’s images as permitted under this Agreement.

8. Copyright & Ownership

(08)

All photographs remain the exclusive copyrighted property of TJ Supreme Media. The Client is granted a personal-use license only, unless otherwise stated in writing. Commercial use, resale, alteration, or redistribution without written consent is prohibited.

9. Force Majeure

(09)

The Photographer shall not be held liable for failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, fire, flood, power outages, equipment failure, government orders, public health emergencies, strikes, civil unrest, transportation issues, illness, or other emergencies. In such events, the Photographer reserves the right to reschedule the session at no additional cost. Force majeure events shall not constitute grounds for cancellation, refund, or damages.

10. Limitation of Liability

(10)

To the fullest extent permitted by law, TJ Supreme Media’s liability for any claim, loss, damage, or injury arising out of or relating to this Agreement or the photography session—whether due to negligence or otherwise—shall be limited to the total amount paid by the Client for the session. In no event shall TJ Supreme Media be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, emotional distress, or loss of data or images.

11. Governing Law & Jurisdiction

(11)

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within Wilson County, North Carolina, and the parties hereby consent to the personal jurisdiction and venue of such courts.
